Client was stopped for a supposed “inadequate headlight.” Client did well on field sobriety tests. A breathalyzer test showed a .07 BAC. Our trial team rejected the offer of DWAI and set the matter for trial. The officer did not show up for the trial and it was rescheduled over our objections. When the officer failed to show up the second time, our attorneys moved to have the case dismissed, and the judge agreed.
