The moment a police officer has probable cause and places you under arrest, three separate legal processes start running simultaneously — and understanding all three matters for how you handle what comes next. Here’s a full breakdown of what a DWI arrest involves from the moment you’re handcuffed to your first courtroom appearance.

The Three Tracks That Launch at Arrest

Track 1: The Criminal Case. The charges against you move into the criminal court system. This leads to your arraignment, your first court date, discovery, and ultimately a plea or trial.

Track 2: The DMV Administrative Process. Independent of the criminal case, the DMV takes action on your license. If your BAC was 0.08% or higher, your license is subject to prompt suspension at arraignment. If you refused the chemical test, the DMV schedules a refusal hearing within 15 days. As NY DCJS guidelines confirm, these administrative proceedings run independently — the outcome of the criminal case does not automatically resolve them.

Track 3: Evidence Collection. At the station, police administer the official chemical test, continue documenting observations, and begin building the prosecution’s evidence record. Under New York’s Implied Consent law, VTL §1194, the chemical test must be administered within two hours of arrest to be fully admissible — and the clock starts running immediately.

These three tracks run independently. Winning on the criminal side doesn’t automatically resolve the administrative side, and vice versa.

Step-by-Step: From the Roadside to Arraignment

1. Formal Arrest

Once the officer determines there’s probable cause — based on FST results, observations, and/or the roadside PBT — you’re formally arrested, handcuffed, and transported to the nearest precinct, county sheriff’s office, or central booking facility. Your vehicle will typically be impounded or towed.

2. Transportation to the Station

The ride to the station is not idle time. The two-hour clock for the chemical test starts running. You should not be answering questions. Understanding your right against self-incrimination in this context means knowing that any voluntary statements made during this period can be used against you — statements made before formal custody often don’t require Miranda warnings.

3. The Chemical Test Decision

At the station, you’ll be asked to submit to the official breathalyzer (usually the DataMaster). This is the most consequential decision of the night. Taking the test and producing a high BAC gives the prosecution its strongest evidence. Refusing triggers an immediate license suspension, a minimum one-year revocation at the DMV refusal hearing, and the refusal itself becomes admissible evidence at trial.

Before the test is administered, you have a limited right to consult with an attorney by phone. Police must not prevent that call — but they’re also not required to wait indefinitely, given the time-sensitive nature of BAC testing.

4. Booking

After chemical testing, the booking process begins: fingerprinting, mugshot, recording personal information, and an inventory of your belongings. Your fingerprints go to the Division of Criminal Justice Services (DCJS) in Albany — and this is how your criminal record is created. An arrest record exists from this moment, regardless of whether you’re ever convicted. This is a point many people underestimate: a DWI arrest shows on your record even if charges are later reduced or dismissed.

5. Waiting for Arraignment

Under New York CPL §140.20, you must be brought before a judge without unnecessary delay — the practical standard established by case law is within 24 hours. In practice, if you’re arrested late at night or on a weekend, it can push toward that limit. Courts operate seven days a week for arraignments in New York, but the timeline varies by jurisdiction.

For most first-time misdemeanor DWI offenders, release on recognizance (no bail required) is common after arraignment, though higher BAC, an accident, or prior history can change that.

6. Arraignment

At arraignment, the formal charges are read, you enter a plea (almost always “not guilty” on advice of counsel), bail is determined, and the judge issues any immediate orders — including the temporary license suspension if your BAC was at or above 0.08%.

This is why having an attorney at arraignment matters so much. The temporary suspension decision, the bail argument, and the foundation of your defense all begin here. The arraignment is also where a refusal hearing is scheduled if you declined the chemical test.

What to Do While You’re Being Processed
